Road defect from project completion

This has had a case open since the completion of tarmac in November last year. The inspection check should not have been signed off until the defect resolved. It isn’t a cosmetic issue. The affected area is worsening. My question is this - given i reported the defect upon immediate completion of the project, why has the inspection taken place and approved? Payment to the contractor should have been withheld before final payment. Why wasn’t this procedure followed and will you have the defect resolved?
