The Highway Agreements Team have reviewed the file, and we cannot see any requirement for the Developer to provide a dropped kerb at this location under the Section 278 legal agreement, nor is it shown on the approved planning drawings available on the District Councils planning portal. We have contacted the Developer to see whether they would be willing to install one, but they advised that the planning officer was opposed due to the nearby established tree, which is protected by a TPO. They did not want any excavation works taking place in close proximity to the tree. As this is an emergency access that is likely to be used very infrequently, if at all, it was concluded that a dropped kerb was not necessary.
While the emergency access may encourage some pedestrian movement, there are existing dropped kerbs within approximately 5–10 metres of this location that provide safe access onto and off the footway, albeit not on the most direct desire line, but provision is available.

The parish Council wish to promote cycling for children and returning cyclists and a dropped kerb would help greatly.
