Noisy Motorbike weekdays at 5AM

Most weekday mornings a motorbike queues at the traffic lights at 5am waking up the neighbourhood. It is very loud and my partner compared it to a pneumatic drill. Having spoken to the neighbours it is not only us that gets woken up at 5AM. I am only assume there is a problem with the silencer on the exhaust/it doesn't have one. It has been ongoing for the last 2 weeks, prior to that I had never heard it before. living so close to an airport and a road you would expect some background noise but nothing ever has been this loud, even despite the road works.

It is not easy to define statutory noise nuisance, but it could be described as an unreasonable interference with the enjoyment of your property. You must experience it regularly and it must continue for a period of time that makes it unreasonable.

Good morning, I have been passed a copy of your email outlining your concerns regarding early morning noise disturbance from a motorbike using the highway near your home. I am sorry to hear of the problems you have been experiencing. Whilst there are limits to the amount of noise vehicles can make on public roads, it is the Police who have the power to take action if a vehicle’s silencer doesn’t work in the way it was designed to or has been illegally modified. (The legislation enforced by the Environmental Health Team would only apply while the motorbike is on private property, for example – where vehicle repairs are taking place). If the noise is continuing to affect you, you may wish to report it to the Police using their non-emergency number by dialling 101. I am sorry that I am unable to be of further assistance to you with your concerns on this occasion.
