Cracked wall due to nearby tree roots

This old birch tree is over 50 years old and approx 50 ft tall. It is approx 1 metre from our retaining wall. The underlying root movement has cracked our wall in a 'U' shape and is now pushing the top stones/coping stones out of place. The paving slabs in our terrace at the top of the wall are also being displaced and uneven which is a trip hazard for us as we are elderly. Our builders have now quoted for remedial works and we are holding the Council responsible for the damage.
