Investigation: Completed (Defect Found) - Thank you for your enquiry. From your report we understand that you have concerns relating to a fallen tree that is situated alongside Public Footpath FK1 in West Haddon. Having carried out a site inspection of this Public Footpath it was found that the tree was not affecting the Public Right of Way, and the route was clear and accessible for pedestrians to use. Within the Highways Act 1980 trees and side-growth adjacent to a Public Right of Way are the responsibility of the landowner. West Northamptonshire Highways Rights of Way Team do not own any land over which a Right of Way passes. As this tree is not affecting access along Public Footpath FK1 and this department do not own it, we are afraid that we cannot carry out any works or give permission for the tree to be removed.
