7.5 tonne truck constantly parked on commercial road

For well over six months this commercial 7.5 tonne van has been parked at different places along Hood Street. It not only takes up 2 spaces where parking is at premium but far worse it blocks out all light to the ground floor windows and when it parks its there all day. After several attempts to get them not to park have been completed ignored.

  • We do appreciate that there are areas in towns and villages across the county where parking is at a premium and people endeavour to maximise the available on-street parking spaces. In terms of commercial vehicle parking (light vehicles such as vans, box vans, semi-trailer trucks etc.) up to 3.5t in weight can be driven with a standard car driving licence. Unfortunately, Northamptonshire Highways have no powers to check the weight of vehicles parked on the public highway nor take either advisory or enforcement action with owners of legally parked trucks or light goods vehicles in a residential area.

    If the commercial vehicles in question are registered as Heavy Goods Vehicles (HGV) with an operating weight exceeding 7.5 tonnes and parked overnight in a residential area, it is likely the driver of the lorry would be in contravention of the operator’s licence. If it is HGVs causing the problem then we would advise that residents perhaps discuss with the driver and explain the parking issue concern and/or contact the management of the haulage firm (address and contact details may be shown on the vehicle) and advise them that this practice is ongoing. If no action is taken by the driver/owner and the problem then continues, the residents can then contact the Traffic Commissioners Office with the vehicle’s registration number via enquiries@otc.gsi.gov.uk or by calling 0300 123 9000. If any particular vehicle is parked on the public highway and proven to have no road tax (members of the public can check if a vehicle is taxed and has a valid MOT on the DVLA website, www.gov.uk/check-vehicle-tax) or the vehicle has not moved for some time and appears to have no owner, then this would be a police enforcement issue and can be processed as an abandoned vehicle. To report an abandoned vehicle, anyone can contact ELVIS (End of Life Vehicle Impound Scheme) on 08456 121 999 or via the Northants police website: https://www.northants.police.uk/ Unfortunately West Northamptonshire Highways do not have the enforcement powers to take any direct action against vehicles parking legally on the public highway. However, a new parking enforcement policy has been introduced by West Northamptonshire Council regarding obstructive parking in certain instances, in order to prevent and reduce people from ‘double parking’, and from parking in front of or on pedestrian dropped kerbs. Further information on this new policy can be found on the following web link: Parking enforcement to be introduced in the new year | West Northamptonshire Council (westnorthants.gov.uk), and contacting the Council’s Parking Services directly on 0345 680 0153 or email to Parking.NCC@westnorthants.gov.uk for their contracted Civil Enforcement Officers (traffic wardens) to investigate and perhaps programme their visits on a more regular basis.

    If there are no parking restrictions in place at this location then West Northamptonshire Council’s Parking Civil Enforcement Officers have no authority to issue parking tickets. The police would only deal with reported parking matters where there is an immediate threat to safety and/or the parking constituted an actual obstruction to traffic.
