Dear Sir/Madam,
I am writing on behalf of Windmill Angling Club, the registered owner of Hunters Pool, located off Hunters Pool Lane, Mottram St. Andrew, Macclesfield, SK10 4QQ. We are seeking clarification regarding the legal status, rights of way, access rights, and maintenance responsibilities of Hunters Pool Lane, which we understand to be an unadopted road.
Background Information According to the Land Registry title CH278139, a Conveyance dated 27 May 1987 states that all existing rights of way, easements, and quasi-easements over Hunters Pool Lane shall continue. However, it is unclear whether the lane is:
• A public right of way (footpath, bridleway, restricted byway, or byway open to all traffic) recorded on the Definitive Map and Statement. • Privately owned and subject to easements granting access to specific parties, including the Windmill Angling Club. • Subject to any maintenance obligations shared among frontagers or users.
Request for Information To ensure we comply with all legal responsibilities and maintain access for our members, we kindly request clarification on the following:
• Is Hunters Pool Lane recorded as a public right of way on the Definitive Map and Statement? • Does Cheshire East Council hold any records of ownership or maintenance responsibility for the lane? • If the lane is privately owned, does the Council have any record of easements, legal agreements, or historical access rights relating to Hunters Pool and Windmill Angling Club? • What are the legal responsibilities for maintenance of the lane, and who is responsible? • Are there any existing rights or restrictions regarding vehicular access along Hunters Pool Lane?
