The tree is overhanging the highway

This tree on Park Lane, Long Hanborough, is overhanging and vehicles are hitting it, causing damage to the vehicles. The roots are on private land but it overhangs the highway. Who is responsible for cutting back? If it's the land owner and he/she refuses, what can be done? Also, the tree is dead so poses a risk for complete falling over.
