Danaged road surface on Hindheath Rd by the garage

Sent to Cheshire East Council less than a minute later. FixMyStreet ref: 6947090.

This road has been reported several times over the past year, months and days to you. There are several large pot holes which because of the wet weather and floods are combining to make the surface dangerous to road users. This is an unlit, busy road, therefore it is difficult to see/avoid these potholes.As the Council responsible for this road and to road users you have a duty of care to to maintain the roads in good order under the Highways Act (1980). In particular Sections 41 and 58 which regulate the maintaining and repairing obligations. In addition section 58 of the act, deals with the Highway Authorities obligations to carry out inspections of the highway taking into account various considerations such as frequency of usage, character and location. I note from previous reports that you have inspected the area in question several times, so in this regard you are aware that there are issues here, but have still chosen to do nothing. This then makes you liable should an accident/damage occur as a result of the damaged road surface/issue. Therefore you would not be able to maintain a defence to a claim that is pursued for damage to person or vehicle. Please note that if my vehicle is damaged because of this road surface I will seek pursue a claim for damages. I welcome a response from you and that you will treat the above as an URGENT matter to be put right.
