Unhealthy Tree

Two horse chestnut trees look very unhealthy. Leaves are brown and no conkers forming like on other trees locally. In high winds they both swayed a lot more than a local tree surgeon said they should. One also has a dead branch which could fall at any time. One of them is also overhanging our property. I don't' want them taken down, just don't want it to drop branches or fall over.
