    "Eligible for Call In Not Eligible for Call In (Details contained in the report)" "EXECUTIVE SUMMARY" "It has been identified that there is a problem regarding loading/unloading along Blayd’s Yard and Heaton’s Court, which are too narrow to safely accommodate these activities. In order to alleviate this problem, it was initially proposed to revoke the existing ‘No waiting at any time’ restrictions along Blayd’s Yard, Blayd’s Mews and Heaton’s Court and to introduce ‘No waiting, loading or unloading at any time’ restrictions along the entire lengths of Blayd’s Yard and Heaton’s Court and ‘No waiting at any time’ along the entire length of Blayd’s Mews. This would ease congestion on what is a narrow one way system by ensuring that loading and unloading is carried out from service yards and not the adopted highway. Following objections that this would impede required loading/unloading activities to businesses at the bottom end of Blayd’s Yard, which is wider, it is now recommended that the ‘No loading at any time’ restrictions are reduced and start at a point past these businesses." "1.0 PURPOSE OF REPORT" "1.0 To consider objections to the Leeds City Council (Traffic Regulation)(WR)(No. W02) Order 2008 to introduce loading/unloading restrictions along Blayd’s Yard and Heaton’s Court, Leeds 1." "2.0 BACKGROUND" "2.1 On 4 September 2006 approval was given to advertise a draft Traffic Regulation Order (TRO) to introduce loading/unloading restrictions along Blayd’s Yard and Heaton’s court, Leeds 1, in order to prevent obstruction by delivery vehicles attending the hotel at the top end of Blayd’s Yard."

    "2.2 Subsequent to the advertising of this original Order, 2 objections were received, which were the same in content; i.e. on the grounds of needing access for their own deliveries. Whereas the hotel has its own service yard, these businesses at the bottom end of Blayd’s Yard do not. 2.3 It is considered that Blayd’s Yard is sufficiently wide enough at its bottom end for other vehicles to pass these service vehicles and the existing ‘No waiting at any time’ restrictions along the entire lengths of Blayd’s Yard and Heaton’s Court will restrict any waiting for the purposes of loading/unloading to 20 minutes maximum. 2.4 Following further consultation with the 2 objectors, they both agreed to withdraw their objections providing that the proposed Order was amended to allow deliveries to their premises. 2.5 It is therefore proposed to uphold the 2 objections and to change the proposals so that the loading/unloading restrictions commence from a point 4 metres north of the yard entrance on the eastern side of Blayd’s Yard. 2.6 Drawing number TMS/10.1/87A, which shows these proposals, is attached for information. 3.0 DESIGN PROPOSALS/SCHEME DESCRIPTION 3.1 The 2 objections received were on the grounds of not having access to their business premises for deliveries and collections. 3.2 It is considered that in order to enable these businesses to carry out their trade, Blayd’s Yard is sufficiently wide at its bottom end to allow loading/unloading. 3.3 It is therefore proposed to remove the proposed loading/unloading restrictions from this part of Blayd’s Yard. 4.0 CONSULTATIONS 4.1 Ward Members and Emergency Services: Ward Members and Emergency Services were consulted over the proposals on 9 August 2006 and no adverse comments were received. This fall back situation was foreseen and consequently all parties are aware of the possibility that this revised proposal would be considered if objections were received to the original proposal. 5.0 COMMUNITY SAFETY 5.1 The proposals within this report have no implications under Section 17 of the Crime and Disorder Act 1998. 6.0 PROGRAMME 6.1 Subject to approval for the objections to be upheld and the proposals amended accordingly, the Order will be re-advertised, sealed and introduced before the end of the statutory 2 year period following the advertisement of the draft Order. 7.0 CAPITAL FUNDING AND CASHFLOW 7.1 Funding: The total estimated cost of the scheme is £5,000 (£2,000 works and £3,000 staff costs) and is covered by the approved sum in the original report."

    "7.2 Staffing: The works involved can be carried out with existing staff resources. 8.0 COMPLIANCE WITH COUNCIL POLICIES 8.1 Ethnic minorities, women or disabled people: There are no specific implications for ethnic minorities, women or disabled people. 8.3 Environmental Policy: The measures are in line with Aims 6 and 7 of the Policy, by introducing and improving overall road safety. 8.4 Mobility: There are no specific implications with regard to mobility. 8.5 Local Transport Plan: These proposals are in accordance with the objectives of the Local Transport Plan. 9.0 RECOMMENDATIONS 9.1 The Chief Highways Officer is requested to: i) consider the objections received to the advertised draft Traffic Regulation Order for the introduction of loading restrictions on Blayd’s Yard and Heaton’s Court, The Leeds City Council (Traffic Regulation)(WR)(No. W02) Order 2008 and the officers comments provided and, having done so, approve the re-advertising of the amended Traffic Regulation Order; ii) request the Assistant Chief Executive (Corporate Governance) to advertise an amended draft Traffic Regulation Order to restrict loading/unloading at any time on part of Blayd’s Yard and all of Heaton’s Court and, if no further valid objections are received, to make, seal and implement the Order as advertised; and iii) authorise implementation of the proposals. 10.0 BACKGROUND PAPERS • Report to Director of City Services dated 4 September 2006. • Draft Traffic Regulation Order - The Leeds City Council (Traffic Regulation)(WR) (No. W02) Order 2008. • Letters of objection and replies.
