Right of way has been changed.

Sent to West Northamptonshire Council less than a minute later. FixMyStreet ref: 5980794.

Field has now been sold and the new owners are erecting a fence, this is now moved the footpath / right of way to the side of the field. Using the OS maps, this footpath goes from the entrance of this field in a straight line to the opposite corner. The new owners have now changed this. As far as I’m aware there hasn’t been any planning notices on this change.

  • The old playing field footpath, it has been noted that the new owners have now erected a fence that blocks the designated footpath within this field. They have diverted this to suit their own cause, and this I believe is in breech of section 137 of the highways act 1980, to obstruct whole or part of the width of a public path. As far as I’m aware no planning has been submitted for the change of route of this path, I’ve searched both parish and county council and cant find such planning being submitted. It is worth noting that this footpath falls within the village designated conservation area and as such should be protected. Footpaths and public access are very important to me, this is part of the beauty of living in such a beautiful area. My fear is that by allowing the change to this path without proper consultation or planning you may be opening pandoras box. This will signal to all landowners within the area that they may change or divert any footpath as the feel fit without any comeback. Many of the footpaths and rights of way have been mapped on OS mapping and have been in their routes for many hundreds of years and I feel these deserve our protection for the next generation.

  • Update. Pictures, one is from the village conservation area plan, dated 1843 showing the route of this path. Another picture is from a drone, highlighted with a red line where the path should be. Spoken to my local councillor with the matter, have been told the family who now own the field can do as they please. They do not need to ask permission for anything they do? How undemocratic?

  • Northamptonshire Ramblers will object to any legal attempt to change the route of this path

  • Northamptonshire Ramblers wish to confirm that this path has been illegally diverted from it's correct route. The historic route should be restored, without any fencing across this path. If the new owner wishes to change this route then a diversion order should be prepared and paid for. Rambers will oppose any route change.

  • Morning, I’ve also placed the complaint with the planning, due to lack of planning permission.

    They have replied with the following: Ref E/2024/6053

    Unfortunately this does not sit within the remit of the Planning department but does in fact come under Highways. My colleagues in the Highways department have advised me that you will need to report this on the councils online reporting system and an inspection will take place etc (the category used would be rights of way)

    We have placed this complaint with the highways, would it be possible to get an update please? Also note they had attached some mapping, this shows the path further into the field unfortunately it won’t let me attach this picture.
