This road has been repaired several times, around the 2 iron manhole covers in the road. Yet again, the repair has failed, the iron is protruding and the road has sunk around the ironworks. This is dangerous to road users and will severely damage a car or tyre if hit, especially if you are unaware of the issue. There are currently no warning signs about the uneven/exposed iron works. Please note that if my car is damaged by this I will seek damages for any repair needed. You have a duty of care to all road users to maintain the roads in good order under the Highways Act (1980). In particular Sections 41 and 58 which regulate the maintaining and repairing obligations. In addition section 58 of the act, deals with the Highway Authorities obligations to carry out inspections of the highway taking into account various considerations such as frequency of usage, character and location. I note from previous reports that you have inspected the area in question several times, so in this regard you are aware that there are issues here but have still chosen to do nothing. This then makes you liable should an accident occur as a result of the damaged road surface/ issue. Therefore you would not be able to maintain a defence to a claim that is pursued. I welcome a response from you. Please ensure that you prioritise this work and investigate who is signing off on the quality control/inspection. This repair was failing within a week of the repair.
