Heading past the Rugby Club towards Bradwall Manor direction towards Pillar Box Lane. The carriageway Road is severely damaged due to a large pot hole. It has now become so big that it is dangerous and will damage a vehicle or road user. Currently, the hole is full of water and cannot be seen. This needs to be fixed along with several other potholes and damage surfaces. This stretch of road has been reported to you now on several occasions since December 2023. I travel this road frequently, in the early hours and at night. Please be aware that if my car is damaged by this I will seek damages from you. You have a duty of care to all road users to maintain the roads in good order under the Highways Act (1980). In particular Sections 41 and 58 which regulate the maintaining and repairing obligations. In addition section 58 of the act, deals with the Highway Authorities obligations to carry out inspections of the highway taking into account various considerations such as frequency of usage, character and location. I note from previous reports that you have inspected the area in question several times, as its been reported over 10 times to you, so in this regard you are aware that there are issues here but have still chosen to do nothing. Ignoring the issue then makes you liable should an accident/damage occur to a road user in person or their vehicle as a result of the damaged road surface/pot hole issue. Therefore you would not be able to maintain a defence to a claim that is pursued. I welcome a response from you, but more importantly please fix and re surface this stretch of road.
