There are a number of very large potholes which have caused the side of the road to fail. As a consequence cars are unable to pass side by side due to the narrow road. These holes will damage a vehicle if hit. These holes have been reported to you several times. Please note that if my car is damaged because of the damaged highway/holes I will seek damages. You have a duty of care under the Highways Act (1980) in particular sections 41 and 58 which regulate the maintaining and repairing obligations. You are quite clearly aware of the defects in this road and as such by choosing not to rectify/repair it in a timely manner, you are failing in your duty of care and are not following your own code of conduct by failing to display appropriate warning signs, failing to investigate/inspect and by failing to repair the road within a reasonable timescale. Please get it repaired properly.
