The owner or occupier of a property has a legal responsibility under The Highway Act 1980 s154 to ensure that the public highway adjacent to a property is not obstructed by vegetation from their property. The tree in the front garden of 32A Canterbury Road, Whitstable, CT5 is overhanging and protruding onto the pavement causing a number of hazards. Firstly, the tree branches force pedestrians to walk nearer the road. Secondly, the branches also obstruct the driver's view of cars pulling out of Suffolk Street onto Canterbury Road. The lack of vision forces the driver to edge out onto Canterbury Road to get a better view to enable them to pull out of the junction.
