Dangerous level of builder's mud on road

The builder working on St Mar Magdalene Church is denying responsibility for deliveries to the site causing mud on the public highway. So far the mud has caused my car to skid and cyclists to skid risking injury. The street is overshadowed by woods and trees, is on the Viking Way and is used by persons walking back from the bus stop on the A253. I reported the matter to the HSE as no banksmen are being used on site, but the builder has goaded me that nothing has been done about the site and its blaming the damage to the road banks on a 'foreign lorry driver' despite me seeing the lorries deliver to the site from both the from and back of my house.

  • The mud is still there causing a hazard. The builders have tried to blame the cause of the mud on a 'foreign' lorry driver, except that my next door neighbour saw how far the German driver drove up the street and helped him back out of the street again without reaching anywhere near the mud which had already been caused by the builders at the church, who have been allowed to cause and hazard and leave it in place without any council action from any quarter. The persons who should clear the mud are the builders, not the Council.

  • The mud is still present but is mostly dried and only becomes a hazard when it rains. The building works on the church will be completed shortly, so the builder will not be around to fulfil their legal responsibility soon, due to the amount of time the Council has taken to act. A disgrace really. I don't want another reminder for the questionnaire as the Council has taken no action to address this hazard since first reported 6 to 8 weeks ago, however if someone now injures themselves on the mud, the Council will now be equally culpable in any personal injury claim.
