This issue has now been further escalated to the appropriate bodies and our local MP.
The details below relating to the running of a recover and car sales business from 97 Burleigh Avenue, Wigston, LE18 1FN and if planning permission and/or an Operators License will be required.
1 - Operators license - As the individual concerned (Mr Emran Esat) and his employees move vehicles for sale on his recovery truck (evidence => https://www.fixmystreet.com/ report/ 1390565 ) it is our understanding that they may require nor only a standard national license as stated here => ( https://www.gov.uk/ being-a-goods-vehicle-operator/ types-of-licence ) but they may also require the full Driver CPC as stated here => ( https://www.gov.uk/ become-lorry-bus-driver ). PLANNING PERMISSION TESTING
Under the current legislation, when working from home, it is my understanding that there is a key test required to pass to ensure no planning permission is required as stated here => https://www.planningportal.co.uk/ info/ 200130/ common_projects/ 56/ working_from_home.
EH Esat has been operating a car sales, recover, storage and maintenance business from 97 Burleigh Avenue, Wigston LE18 1FN since before 2010 and despite numerous people reporting them, no checks regarding planning permission have been made.
The tests are (with our position stated alongside to support this request)
1 - Will your home no longer be used mainly as a private residence? - Not applicable to our knowledge.
2 - Will your business result in a marked rise in traffic or people calling? - Yes it has, parking spaces have become more limited due to several cars being stored long-term in the residential area alongside 2 trucks and 2 trailers (neither lit or attached to a vehicle). 2 of which very rarely move.
3 - Will your business involve any activities unusual in a residential area? - Absolutely, reported noise, car maintenance and truck repairs on the road along with several vehicles being loaded and unloaded into the recovery trucks.
4 - Will your business disturb your neighbours at unreasonable hours or create other forms of nuisance such as noise or smells? - Noise, no parking spaces, constant anti-social behaviour as no consideration given to neighbours safety or quality of life including telling people to "move if you do not like it!" when asked to move vehicles so owners can park close to their homes.
These examples clearly show that a permit may be required.
The police have acted when his loaded trucks were causing obstructions, but he still is allowed to cause issues by operating from home in this manner.
This issue has been present since 2010 and the residents affected will no cease to report this matter whilst he is allowed to continue impacting on so many lives in this area and beyond.
I shall also be reporting this matter via your anti-social trigger reports and via our local MP and Council representatives.
