Sunken reinstatement to highway.

Reinstatement by the housing developer has been inadequatly compacted (well. probably not at all given it happened the last time he did it as well) and the road has sunk to an such an extent that it is a hazard to cyclists avoiding his traffic cones (which are not tin accordance with Chapter 8) and any car passing by. Can we now expect them to be fined under the RASWA or is this a vain hope? This has been here for > 3 weeks now.
