Road Surface broken up

I'm registered disabled and the only real mobility I have is with my car. The cul-de-sac in which I stay has a mostly broken surface which is dangerous for me to walk on but I have no choice as I have to get to my car. I have asked the roads dept. to do something but all I get told is maybe next year. If I do fall and hurt myself who do I sue?
