Leylandi Hedging

There is a short section of the above which is about 30 ft tall and which about a year ago was clipped up to about 6/8ft high and as a consequence is now completely top heavy. In even moderate winds it sways alarmingly and had now started to affect the wall - it is in danger of failling over.

The ivy trailing on the pavement on Ellesmere Avenue has been cleared. However, the main problem the leylandi hedging section which fronts onto Pensby Avenue. Whilst we appreciate it is on the owners property, due to its excessive height and being totally top heavy - should it fall on the road, several cars which have to be regularly parked within reach of the hedging should it fall, are extremely concerned that serious damage and/or injury to pedestrians will certainly result. Should it fall in the other direction, then damage to the owners house is inevitable and we would not want that either.
The Council have visited and the ivy that was trailling over the pavement has been cleared and hedging has been cut back and up to the height of about 8ft on Ellesmere Avenue. The Council informed us that as the Leylandi was the responsibility of the owner as it was not encroaching the public highway. What concerns us, however, is that as it is so precarious and liable to topple over and potentially hurst someone/damage property - does that have to happen before something is done?
