Improper use of private bin area

Flats 133-185 Heathdene Drive have their own bin enclosure with 4 paladins for the exclusive use of flat residents. We have been experiencing problems with house owners near the flats who leave various items of waste in the bin area or in the paladins. In the last week old plastic guttering has been dumped. These home owners have in the past been told orally that this is a private area and they should desist from leaving rubbish there - to no effect it seems. Are these persons responsible for fly tipping?
