Cleaning and restoration of pavement
Reported in the Pavements/footpaths category by Mike P at 14:39, Sun 9 December 2007
Sent to Leeds City Council less than a minute later
The boundary of the semi detached properties on the corner of Stainbeck Road and Stainbeck Lane has been changed. Substantial change has occurred by way of felling the trees and replacing them with a 'Bradstone' type wall. The pavement has been damaged by the tree felling process and further affected by the non clearance of excess mortar/cement used in the building of the wall. Time has elapsed since the wall was built, pillars capped and fence units installed. Another example of inconsiderate builders/occupiers/owners with regard to Leeds City Council property and neighbourhood amenity. The pavement needs at least power-washing and at best relaying.

No work has been carried out to clean the pavement and/or resurface/repair the pavement. It is clear that whoever commissioned the wall has little or no comprehension of due care towards other peoples property, in this case Leeds City council's property. I trust that the cost of repairs will be met by the owner/occupier(s) of the property/properties who now have the new boundary wall, NOT paid for by LCC out of Community Charge payers pockets. I will flag this up with a Senior LCC person. << Watch this space >>
Leeds Council gave the owner(s)/occupier(s)/contractor(s) until 26th Jan. 2008 to restore the pavement to a declared LCC standard. The work was not fully carried out and LCC extended the deadline to 1st Feb. 2008. The work has been carried out to a very unsatisfactory standard and has been further reported to LCC. The suggestion is that Leeds City Council do the work and invoice/bill those responsible. << Watch this space >>
The owner(s)/occupier(s)/Builder(s) have not restored the pavement to the required Leeds City Council spec. LCC will restore the pavement and invoice accordingly. The work is repeatedly being delayed by other 'urgent' work. I have sent details to the Councillors hopefully to get the matter progressed. << Watch this space >>
LCC have the work scheduled but other priority jobs have delayed the work. Apparently the whole pavement area around the corner will be re-tarmaced and the area ruined by the owners/occupiers will be invoiced to them.
LCC have re-tarmaced a large proportion of the damaged pavement and assure me that the cost of tarmacing the damaged area will be recovered from the owner(s)/occupier(s). An area outside the entrance gate adjacent to the cable box was not retarmaced. LCC say the area is 'stained' with mortar/cement. In reality it has mortar/cement deposits. A new fault will be raised.
The areas that constituted a trip hazard have been re-tarmaced and a portion of the bill sent to the owners of the properties adjoining. There are amounts of mortar/concrete on the pavement which is seen by Leeds City Council as a 'stain.' This is being progressed separately. << Watch this space >>
It seems rather pointless asking the Council to attend to a Civil Ammenity matter. They have no intention of removing the deposited cement.
A request for information has been made under The Freedom of Information Act. It will be interesting to see whether the owners/occupiers of the properties paid for the tarmac they ruined to be re-instated or whether the Council Tax Payers picked up the bill. << Watch this space >>
I will raise this as a separate complaint/incident together with a photo. These 'stains' are deposits!
I'm still awaiting disclosure information from Leeds City Council. The matter of residual mess will be raised under a separate 'fixmystreet' entry.
Apparently the Council are 'pursuing payment.' << Watch this space >>
Apparently the Council are 'pursuing payment.' I will keep an eye on this as I don't want the Council Community Charge being used to pay for a repair to a footpath. << Watch this space >>
I'm still trying to get confirmation from the Council that the owner/occupier has paid for the remedial pavement work. << Watch this space >>
Leeds City Council are still pursuing payment. I'll not let it drop and will ask LCC to keep me in the frame re their actions. << Watch this space >>
I will be contacting LCC soon to see just how 'Actively' they are chasing payment. << Watch this space >>
Still no confirmation from Leeds City Council that those who caused the damage have paid their part of the bill. So much for a caring Council. Poor or nil response from Council staff. << Watch this space >>
I'm now advised by The Local Government Ombudsman that they can not help in this matter. I'll make another FoI request. << Watch this space >>
Apparently the owner(s) / occupier(s) of the property are paying off the amount due, in instalments and have paid off about 50%. << Watch this space >>
I need to check on the 'payments made' situation. << Watch this space >>
I need to check with LCC re. the progress payments being made for the tarmacing. << Watch this space >>
I emailed the contact in Leeds City Council a few weeks ago for an update on the payments; no response has been received. I will chase via the Chief Executives Office. << Ongoing >>
The matter has now been referred to The Information Commissioners Office due to LCC being unable/unwilling to give me an update on the state of the account. << Watch this space >>
Apparently the 'bill' has been paid in full. I will be making a further check via another contact as I tend not to believe all I'm told by certain folks. << Watch this space >>
Awaiting confirmation that bill has been paid in full. << watch this space >>
